'To be determined' - Scottish Right to Rent roll-out

Right to Rent checks, a requirement under the Immigration Act 2014, commenced in England in February 2016. In Scotland, a commencement date has not yet be identified. But the Home Office are quite clear: it will be coming to Scotland.

An obligation for landlords to check a prospective tenant’s ‘Right to Rent’ was introduced in the Immigration Act 2014. The purpose of this was to help create a ‘hostile environment’ for migrants with irregular immigration status. It involves landlords checking prospective tenants immigration status before letting. Penalties for failing to carry out these checks started off as a fine, and have been increased to a possible custodial sentence as part of the Immigration Act 2016.
