SFHA response to consultation on removal of 'presumption' in favour of sustainable development from Scottish Planning Policy
The Scottish Government's technical consultation sought views on proposed amendments to the Scottish Planning Policy (SPP) in the wake of the recent Court of Session decision in the case of Gladman Developments Ltd.
In addition to the removal of the 'presumption' in favour of sustainable development (sometimes known as the 'tilted balance'), the consultation sought views on the Scottish Government's "aim of clarifying the definition of the 5-year effective housing land supply to reflect the currently exceptional market circumstances" as well as changes to the proposed calculation to establish the scale of the 5-year effective housing land supply in relation to alternatives and the approach to addressing proposals where a shortfall emerges.
