SFHA Charitable Model Rules

The SFHA Charitable Model Rules (Scotland) 2013 (as amended 2015) have been produced in conjunction with our membership, and approved by the Scottish Housing Regulator, the Office of the Scottish Charity Regulator and the Financial Conduct Authority.

The SFHA Charitable Model Rules (Scotland) 2013 (as amended 2015) have been produced in conjunction with our membership, and approved by the Scottish Housing Regulator, the Office of the Scottish Charity Regulator and the Financial Conduct Authority.

This is the most up-to-date model available, and as such is the recommended model to use if you are looking to make constitutional changes.

The model, and a version tracking changes as compared to the previous 2009 model, are available to download. 

If you are looking to adopt the SFHA Charitable Model Rules, or you are seeking to amend your existing Rules, the SFHA has developed the following guide that outlines the process to follow, and the necessary consents you must gain.  

We have also produced further guidance as to how you can adapt the SFHA Charitable Model to fit your organisation's needs if it is:

  • Non Charitable;

  • Community Based;

  • A Fully Mutual Co-operative;

  • A Model Co-operative;

  • A Subsidiary.

The SFHA also provides a Rule Amendment service, whereby we ensure:

  • Rules have been submitted in the correct format

  • Associated documentation has been completed correctly

  • Amendments to Rules are consistent with 2013 Model Rules

An administration fee of £25 + VAT is charged for this service for Members and £50 + VAT for Non Members.
