Property Factors (Scotland) Act 2011: Code of conduct for Property Factors

Revised draft of the code will be implemented from 16 August 2021, subject to Scottish Parliament approval.

The Scottish Government has produced a revised draft of the Code of Conduct for Property Factors which will be implemented from 16 August 2021, subject to the approval of Scottish Parliament.

All registered property factors are legally required to comply with the code which provides overarching standards of practice and is part of the Property Factors (Scotland) Act 2011.

The revised code replaces the previous version published in 2012 and contains various updates, including details of the First-tier Tribunal for Scotland Housing and Property Chamber which replaced the Homeowner Housing Panel in 2016. The code also makes reference to the recommendations of the Scottish Parliamentary Working Group on Tenement Maintenance which were published in 2019. The Scottish Government responded to the group’s recommendations, highlighting the important role of property factors in maintaining common property and committing to further action to improve standards.
