SFHA is an organisational member of a Scottish Parliament Working Group on Tenement Maintenance, which was convened in March 2018 to explore what actions could be taken to improve the condition of Scotland’s tenements. One of the Working Group’s recommendations was that every tenement building should have an owners’ association to coordinate work to the building. This recommendation as referred to the Scottish Law Commission to implement the recommendation, and the commission recently published a Discussion Paper on implementation for public/stakeholder consultation.
SFHA is hosting a webinar on the recently published recommendations for implementation on Friday 21 June, 10:00-1130 to discuss potential implications for our members.
The Scottish Law Commission will be in attendance to provide an overview of the relevant parts of the proposal, followed by facilitated discussion and Q&A. The event is for all members with an interest in tenement maintenance/ repair and management, including members of our Building Safety & Maintenance Forum and Factoring forum, but all are welcome. Please bring your questions for the experts.

The Discussion Paper considers the functions and powers of the owners’ association, how decisions will be made and challenged, costs liability, exemptions, and more. The Scottish Law Commission will provide a summary and SFHA will collect input on a subset of the Commission’s consultation questions to inform our response ahead of the August 1st deadline.
